Not Violent....Just no longer silent.

More than fifty years ago the United States Congress passed a law ......[(USC 1304(e)]....which mandates that all resident aliens carry their identification & immigration papers on them at all times & present them to any law enforcement agent that asks to see them. You with me so far? Ok. good. In 2005 the United States Supreme Court noted that it has repeatedly ruled that mere police questioning does not consitute a siezure under the 4th amendment. Still with me? Good. For thirty years the Federal Government has made only token efforts to control illegal immigration. Congress proposed to build a wall along the entire length of The Southern Border of the United States Of America.....but then President George Bush bid that down to a high-tech "virtual fence". Our current President has stopped construction of even that. Historicaly Republicans were said to turn a blind eye to the problem because their business buddies needed cheap labor to oppress. Democrats, for all their assertions otherwise, love illegal immigrants because they love a dependent class, thus their willingness to grant them the rights & privilges of full citizens.

If you give a hungry man a fish he'll eat today....If you force every productive member of the tribe to give him a fish everyday......he'll vote for you every time.

Which brings us to Arizona. The state Legislature, at the behest of over 80% of the state's population, recently enacted legislation which establishes the State's right to enforce laws already on the books. And so of course all the usual baffoons are acting up.

I guess he doesn't care that 72% of African American & 68% of LEGAL Latino immigrants, in Arizona, support this law.

We know The Good Reverend is an honorable man...... Laura Sydell of member station WNYC reports that Reverend Al Sharpton testified that he never asked Tawana Brawley about her accusations of rape and assault. Brawley claimed that a group of white men attacked her in 1987. Sharpton took her accusations public and named Stephen Pagones as one of the assailants. After his exoneration by a grand jury, Pagones sued Sharpton and others for defamation, and won.

A group of prominent black leaders pooled $78,000 to bail the Rev. Al Sharpton out of the judgment he still owes from the 1998 Tawana Brawley defamation suit. "If there was no Al Sharpton, who would there be?" said Percy Sutton, the 80-year-old media king who organized the effort. "There is no one doing what [he's doing]. He raises issues to bring about constructive change." The donors include Amsterdam News publisher emeritus Bill Tatum, Black Enterprise magazine chairman Earl Graves Sr., Essence magazine publisher Ed Lewis, auto dealer Richard Gidron and attorney Johnnie Cochran. Sharpton was ordered to pay $66,000 to Steven Pagones in 1998 after a jury found that he and others defamed the former Dutchess County prosecutor by accusing him of raping Brawley. Paganos had received only $6,000 as of January, prompting him to go after Sharpton in Manhattan Supreme Court. The $78,000 will cover accrued interest as well as the judgement, Sutton said. Tatum said he was a willing contributor because the "white press" has used the Brawley case to "lynch" Sharpton and that Sharpton should not have lost the defamation suit. "We have delivered him away from the harassment," he said.

But back to Arizona. 85% of illegals apprehended there are Latino. Latinos make up roughly 30% of the population of legal citizens. The new law explicitly states that race or ethnicity cannot be the determining factor of probable cause. It also mandates training for all officers in an effort to instruct them what constitutes probable cause.

This is indeed a troubling turn of events. I fear abuses, as I think everyone does. But this poses questions of State's Rights Vs Federal Control. It also highlights the hypocracy of both parties (as opposed to the philosophical underpinngs that were once the hallmark of those parties). The narrative is already taking shape....Harry Reid in particular is MOST anxious to get "Immigration reform" on the table because he knows that his party, with the help of a compliant press, can use this issue to spotlight the "Anti-Hispanic" nature of Republicans. The Republicans are counting on fresh blood from Tea Partiers But Tea Partiers are devided as to how to move forward with illegals already here, but very united in the desire to "Secure The Border(s)". And I think this "secure The Border(s)" outlook is shared by a solid majority of Americans. Neither Party is likely to actualy do this, of course, & will continue to disregard the will of the people.

Which again brings us back to Arizona, by all accounts the entryway of choice for smugglers of people & drugs. (Don't get me going on the war on drugs!!!!!). Do the People Of Arizona have the right to defend itself. The President has called the law misguided, & I'm sure it is. He has asked his justice department to look into the legality of Arizona's new law. Yeah, good luck with that. But then again this IS the justice department that decided not to prosecute club weilding Black Panthers who were shouting racially charged comments at white voters in myriad polling places, so who knows? But if it gets to the Supreme Court.....The Feds will lose, big time.

    I can see where the AZ folks are coming from...but, I don't think it's the right law for now. Who's an American is not really an AZ issue..Many questions are raised, I hope we can answer them as a country..honestly. My hopes aren't too high for that, but I don't blame the AZ folks for standing up. Something needs to be done.

    That is one of the big reasons why I applaud AZ! I don't understand what's misguided about? BTW I been argueing about this bill on Facebook since yesterday.

    @CodyB: One thing you can't ignore is all the violence that is being commited along the border & in many of the southern states. This bill may offend people, but I think it does help address this issue of violence. I don't see the problem for asking for paper's, or ID.

    @ Cody B & RGM.........This law troubles me.....its an anxious feeling....nothing in particular,,,,I just feel there is much room for abuse.  Having said that...given the inaction of the Feds in this matter...& given that Im a HUGE supporter of State's Rights.......I have to applaud action over inaction.

       I part company with a great many conservatives on the issue of illegals already in the country.

    Interesting you mention the Brawley case for I was discussing it with a friend earlier today. I was horrified when I heard about Tawana Brawley's case when I was 14 in 1988 and infuriated more when I found out she LIED when I was 15 in 1989.

    Unfortunately one of the pastors in my church was one of her lawyers. Because of Tawana Brawlery's actions my pastor got a bad rap in defending her. He had to change his career because he couldn't work in the legal profession any more for his credibility was questioned. He was a broken man but fortunately he was able to go to seminary school (while working odd jobs in supporting his family). 

    Some people don't realize how LIES can ruin the life of someone else. 

    On this issue of in Arizona, I think there is a better way to enforce this law in the 21st century. However, asking for an individual's immigration papers and identification is much better than how I may have been treated 80 years ago. I don't mean to be so graphic but this may have been a possibility African American Lynchings . Emmitt Till's story haunts me till this day. Although I know times have changed, I can't ignore the past. 

    I'm not from Arizona nor the West Coast so I don't know the climate there when it comes to this issue. I don't know if this is the best way to combat illegal immigration or what is the ideal way to stop it.

    Illegal immigration is so bad in some parts of Italy with some Africans that they are being killed! See here

    That could actually be true..or not. I've heard legal scholars call it both ways. I don't think the legality of it is the issue though.

    Call it what you like...the law will not stand..or, if it does, AZ will have to leave the USA. Which is OK by me, if that's what they want to do.

    Ultimately the debate is about defining what it is to be an American and immigration..questions we have failed to adequately address since the country was formed.

    So far it has boiled down to..come on in when times are flush, we need you and then when times are bad, stay away.

    C'mon Cody...it's about doing things the way they are supposed to be done. They skip across the border and drop the anchor babies, take jobs we need, commit more crimes than citizens and on and on and on.

    I have NO problem with LEGAL immigration...I have a HUGE problem with trespassers with their hands out, as if we owe them a living. Then they scream for "amnesty".

    How is that fair to those waiting for thier turn, doing it legally?

    You really think "they" come here for hand outs?

    The image of the lone border jumper coming in and robbing from the mouths of Americans is a nice image..

    But most people arrive here trafficked, after paying huge sums of money (to them)...they've been told it's a "land of milk and Honey"..Many have below minimun wage jobs waiting for them (supplied by Americans).

    As always, this is about the money.

    And you could spend billions on a wall...but it would not do jack, because supply and demand would find a way to get cheap labor into this country. Cheap labor or free labor is very popular here with people who own businesses, or like a nice lawn, or think childcare costs too much. Except when unemployment is high..then all of a sudden..these people are taking American jobs.

    I'm not talking about the few people who come here just to abuse the system...I'm talking about the people who came here to work, were hired to work, pay taxes, aid the economy,etc,etc...the folks who, like millions of immigrants before them, help keep the country growing and vital..

    Is it fair for those folks to be lumped in with criminals,narcotics traffickers, and tresspassers?

    ..I don't think so.

    Is it fair that they are allowed to work here (presumably benifitting some American directly) for an extremely low wage, under harsh less than human conditions, under threat of expulsion if they complain about anything or stick up for themselves?

    ..I don't think so.

    I'm not saying I like the way thngs are, I'm not saying we shouldn't protect our borders..but I believe there's a lot more to it than putting up a fence and enacting enforcement procedures that are really questionable. Whether I agree or not, or whether they are technically legal or not is going to be argued..but it still isn't the point to me.

    Flip back the history book and you will see a version of the exact cartoon DM³posts with the statue throughout time..slightly altered, but the same concept.  That tells me, that our "immigration problem" has existed since (and before) the Statue of Liberty was built.

    The arguments for and against are also very similar throughout time..so I think we need some new arguments..

    ...a bold, foolish, & totally erroneous assertion on it's face. The law will almost certainly stand.  Texas & New Mexico will follow suit.  The Feds have refused to act......

    ......One cannot blame the states.  BY LAW Arizona cops must enforce Federal law.  The ONLY change is that now police action is codified.

    Several things popped in my head reading this.

    1. I hate the fact I can't post from my work computer anymore (the biggest reason for my recent apparent hiatus)

    2. Kids below age 3, especially two of them, are toxic to my appetite for the mog.

    3. Penn and Tellers show "Bullshit" had a great peace on the fence and immigration a few years back.

    4. The Federal government has a ton of tough laws to hammer companies that employ illegal immigrants and the fines are enormous.

    5. The agency in charge of that consist of a blind guy and a jerriatric with a walker. They work for politicians who on both sides of the isle count on those businesses to contribute campaign funds (campaign reform anyone?)

    6. Gather up every single illegal immigrant in the country with SWAT TEAMS, practically George Orwell in nature, throw them in vans and have the entire country swept in 30 days, do it in a fashion that makes Hitler's attempt at collection people of unfavorable traits and religions seem like childs play.

    7. Throw them all across the border, then promptly have them line up in que, finger print them, photograph them with face recognition software (its already being done to you at your local DMV folks), give them a quick quiz on the English Language and Government/social studies, and a background check against the FBI, CIA, DEA and State and Local Authorities (that system was supposed to already be in place with the DHS). 

    8. If they pass with flying colors, give em a SS# and a bus ticket back to the city they came from.

    9. Once that is done, build a 10 foot deep, 20 foot high wall, man it with machine guns, and put a one stop shop "Immigrations" Check point every few miles, where folks can show up at 7AM in the morning, and be on the other side by 5PM as US Citizens.

    10. Put Cameras on every corner with facial recognition software in every city town and state in america.  If you aint one of us, the men in black come to get ya.

    Open it all up, let people come and go as they please, terrorist will walk in with bombs, the poor legal citizens will only get poorer, because illegals will take more and more of the low income jobs at rates cheaper than what legal citizens are required to get paid. Government will crumble due to lack of funds and the health care system will be forced to support illegals who are not required to have health care, the middle class will suffer as their employers taxes go up to pay for the missing income taxes, and the middle class will face a devaluation of the dollar, the rich will then be the next to feel the pain, and eventually the whole thing collapses into a communist republic.

    The fact remains, you are either on this side of the arguement, or the first one I put out.  And anyone claiming the want a middle ground is simply wrestling  with their own concious about their inner unconcious feelings of being a enlightened communist or a realist fascists.

    (Hows that for stirring the pot Bones)  :)

    it's not me who's saying it DM..it's legal people..I'm not gonna interpret the law, I haven't been to law school...as I said earlier, there are questions of the AZ law passing judicial review..I've heard instant analysis that goes both ways.

    So if the law doesn't fly and AZ wants to keep it there will be a problem..that's all I'm saying..

    If anything is bold, it's them passing the law...which ultimately is gonna be superceeded by a Federal law..

    On a technical level, all it's really gonna do is clog their courts..it most certainly isn't gonna stop illegal immigration. I feel sorry for the cops who have to enforce it. It really just seems like a cosmetic..putting a band aid on a bullet wound.

    At least it's a start. There is a 10th amendment issue in this, as well. Funny how the Feds only enforce what they want to enforce. If this administration does nothing, they'll reap the benefit of all those Latino votes in Nov.

    BTW, just to clarify my position, I'm NOT a bigot. My wife is Hispanic, and has a green card. We've had some lively discussion on this issue!
