Cheaters never win

As a teacher, there is one thing I really do not like and that is cheating. I never stood for it, and never liked watching someone get credit for someone elses hard work. Fall Out Boy is in the process of getting sued once again for using someone elses ideas. This comes after reaching an out-of-court settlement with South Philly's Wesley Eisold of the band Some Girls, after co-opting some lyrics from his old band American Nightmare and other poetry Eisold has published. What got them in trouble this time around, well Nicholas Hans of the band Knives Out, alleges the band took a phrase and concept from a T-shirt he designed and used it for lyrics on a track from the multi-platinum 2005 record "From Under the Cork Tree." In 2001, Hans' former band Knives Out, toured the U.S. and sold a black T-shirt with a drawing of a hand with a ribbon tied around the wrist and the phrase "Don't Open Till After X-Mas." The line "The ribbon on my wrist says, 'Do not open before Christmas,' " is part of Fall Out Boy's song "Our Lawyer Made Us Change the Name of This Song So We Wouldn't Get Sued" (which refers to an unrelated matter). "They 100 percent ripped us off," Hans said earlier this week. "It just pisses me off. They should have asked," says the artist/musician. He's meeting with a lawyer to discuss possible recourse.   1. kaleef says omigod. how do you get me to watch these things all the way through. did you _see_ that dude clapping at the end. oh man, and didn't fall out boy get in trouble with their name too? they robbed it from a comic on the simpsons... i think, they didn't ask to use it or something. i just heard this the other day but could care less, because, well, the band sucks.

  6. SamTheButcher says Wait, wait, wait just a minute. Knives Out is thinking about suing FOB because FOB used a *lyrical* representation of a t-shirt? Am I the only one who thinks that's ridiculous? Maybe it was homage? You didn't link to an article or anything, but seriously, that strikes me as WAY overstepping bounds. Next you won't be able to sing about the Empire State Building or your favorite TV show. Sure, I like FOB's songs, but I'm no fanboy. This just sounds like the "I, me, mine" mentality that's so prevalent these days. But it seems like that's just me....

  10. greeninkstains says I am by no means a FOB fan. But there are a lot of bands who take their names from other sources. Death Cab from Bonzo the Dog Doo-Dah Band in the Beatles' Magical Mystery Tour or Radiohead from a Talking Heads song, for example. However, Fall Out Boy has been pissing me off lately, so I'll listen to anyone bashing them. Plus, cheating really makes my blood boil. Especially, as a college student with the massive amounts of plagiarism that occur in today's Internet/Wikipedia world.

  12. Nixne Svix says alh Fistula , you beat me! Has anyone else noticed....shhhhh....they kind of suck anyhow? Ill take Knives Out on their word because frankly , their name is waaaaay more original and therefore I believe them, I know its totally baseless and unfounded; like FalloutBoy!

Nixne Svix says and while one may argue that Knives Out is aa Radiohead , it is also a reference to the beginning of a fight and could be found many times BEFORE radiohead were even born in Literature and Art; but youd be hard pressed to find the phrase 'Fallout Boy' in any pre-cold war era Arts and Lit....just saying...

  14. chulsmith says this is retarded. pardon my un-pc use of the word. seriously. it's just a way for knives out to try to get some ching from fall out boy. pretty soon, all bands will have names like !!! or 0+> or whatever the prince deal is. and they'll all be instrumental bands because no one can sing lyrics because all of the words have been used in the same order in the past. um, stupid.

Lizziegreeneyes says I can't even stomach FOB - but I agree with Samthebutcher, Soundchkr & ma boy River Lethe ... most everything - especially in this day and age - is inspired in part by something someone else did. I would have a problem if they took lyrics directly from another band - or from a poem, book etc. but to sue them for almost certainly referencing a tshirt - that's just sue-happy America if you ask me - I mean seriously - what a-hole takes a scalding cup o' joe and places it precariously on their lap and not expect to get burned ... haha - I made a funny, I dropped my coffee and now I'm a gonna F McDs !!! tee hee hee - look at me ...I'z rich and proved to all how stupid I is !!!

  16. Rawkkiddoh says I agree with all of you on this one, taking action because someone got an idea from an idea that you had is wrong. On the flip side, I could see getting upset from an artistic point of view. Being an artist, nothing gets me angier than making something, then seeing someone else take what you did, put a spin on it and take credit for it. II think when it comes to art some people do not like to see their ideas tainted.

I mean, it seems a pretty original idea and if you've ever seen the t-shirt, you'd know if you heard the lyric. Now, if you said "Oh, FOB, that's a great lyric!" and they just said "yeah", then I still see no fault. If you said "It's just like that t-shirt" and they said "oh, no, WE MADE THAT UP!" then yeah, call 'em on it, but I still don't think it's sue-worthy. Thanks for stirring up the pot, Kev. You're really good at this! :)

  18. mktackabery says well, not to insert "prick lawyer talk" here, but you can be sued over the representation of an idea. Technically they are in violation of strict copyright law. The t-shirt pictures a wrist with a ribbon around it and the words, and the song explicity mentions that image and the exact words. Representation=representation, strict copyright violation, plus the words on the album indicates they knew they could be in violation. They might as well have written "somebody sue us please" on their foreheads.

  20. SamTheButcher says Just seems ridiculous to me, is all. But then again, I'm one of those "patents are broken" dudes (which I know isn't copyright), but it seems like.... Well, I've said it upthread. I don't think it's like Joe Rogan calling out Carlos Mencia (who's actually Honduran/German, not Mexican!) is all I'm saying. :)

Lizziegreeneyes says Right, so, remember when I said I couldn't stand FOB - well, I still can't stand them - but I gotta state for the record - I've been looking for that song for ages (the one from the YouTube Dance,Dance video). It was truly painful to watch :), but I stuck it out to the end and got to hear that song all the way through ... THANK YOU Rawkkiddo !
