Excel Vs Metallica Battle over copyright Part 2

I did a post previously on a band called Excel that accused Metallica for copyright infringement on one of their tunes. Here's a tune off the same Excel album, listen and compare

    It don't sound like anything I've heard metallica play ever before. 

    It is a cool track however! It's late 80's thrash... at least a bit anyway.

    I thought these guys came out way after Metallica made it big with Master Of Puppets.

    Doomsayer2001 : Really, I think that A# minor power chord part sounds a lot a like. They use to be called Chaotic Noise, and I think your right they came out a little after Metallica. The drummer , and Guitarist , both played in The Infectious Grooves with Mike Muir from Suicidal Tendencies. They were a Venice Beach punk band like S.T. ,  they were also known as a Crossover band, Punk/Metal is pretty much what it was. The name Crossover came from D.R.I.'s Crossover album.
