Oh gosh, another PR gaffe for the Red Hot Chili Peppers, I love these guys but I really think they need to fire and rehire in the legal and PR departments - sigh.

As previously posted by me elsewhere:

"Whether the title 'Californication' sort of 'belongs' to the Peppers? I don't know, but yes that word is VERY much associated with this band and here in the UK the series was advertised using their song.

Saying that, the series' title is not the only reference I noticed to the band; if I remember correctly, in episode three I think it was, remember when character Hank's agent is, errrrrm, enjoying himself watching his PA's naugthy website? Remember what she calls herself on that website? I am pretty sure it was "Dani California".

But hey, I do find the series entertaining, and as much as I could understand the band wanting to sue the TV series production company, it would have been a hell of a lot more credible if they'd done so a hell of a lot sooner (as in: before it was ever televised in the first place).

As the band('s lawyers) left it so late, just as the show's ratings aren't quite as great as the makers had hoped, I can't help but think that this is not a genuine complaint/suit, more like an arranged/engineered publicity stunt as agreed between the show's makers and the band('s representative), knowing that the publicity it might bring, might actually boost both the TV series' ratings and RHCP album sales.

Wanna bet this "case" never makes it into a courtroom, yet gets "settled" outside court?"

"Like I said before, this whole situation just reeks of "publicity stunt" to me, not necessarily initiated by the band, more likely initiated by either those working for them (management, record company, or PR people) or even initiated by the series' makers now that the viewing figures aren't as good/high as they had hoped for (if the claim had any seriousness, it would have been brought about earlier, before the show had even aired anywhere).

Negative publicity like this benefits all parties involved. (But if I'd been their PR-advisor, I would still have advised against it, or only let it take place with a positive twist.)

Note also that Showtime is a subsidiary of Comedy Central, with whom the band have already had business connections (like when they gave their voices to the Simpsons and to Lil' Bush).

Besides that, do you really think the series' legal advisers never bothered to check things to prevent any lawsuits?",

"The show is great, I love it. And yes, the whole thing sounds lame - but like I said, I don't think it's all that serious, and probably not even initiated by the band.

That said, I really think the band should re-consider who they are working with / who they allow to work for them, because I think they are falling victim to too many publicity gaffes. (I'd do better - and cheaper.)"

"If 'by association' is enough grounds for a lawsuit, then I suppose any RHCP fan could associate the show's main character 'Hank Moody' with Anthony in a way; a 40-something guy, driving a Porsche, promiscuous yet desperate for (re)commitment, whose writing contains a lot of sexual references, who is a womaniser with a preference for very young ladies.....

The reference made by many TV networks advertising the show using the RHCP song "Californication"; but that may not have necessarily been the show's makers' doing."

"I already mentioned the 'Dani California' character previously, and oops, sorry, I think I may have leaked this bit of info to the press well before this case came up (when someone asked me to review it from a RHCP-fan point of view, considering they already made the association with the band before the series aired); in episode 3, there is a scene where you see Hank Moody's agent pleasuring himself while watching this website of 'naughty pictures' of his PA; on that website she calls herself Dani California. So when I was asked to write a review, I incorporated that bit of info.

In my article I also incorporated the other associations I mentioned in this and other posts, and I might have even mentioned that if show ratings failed they could always try to stage some sort of PR-stunt involving RHCP (though I didn't mean a lawsuit!).

Hope that didn't get anyone into trouble."

  2. Sturgell says I was reading about this yesterday. I think it's pretty screwy that the people behind the TV show thought they could just sort of slip this by RHCP. It's a rather blatant use of one of the groups landmark songs. I suppose worse thing have been done in the history of the entertainment biz. ??Califrownication?? ...? girl, you crazy.

Jo says But let's be realistic here, as much as I witness the association, they didn't invent the word Californication, and even if they had grounds I don't see how these charges/claims reflect so well on them PR-wise (there may be no such thing as negative publicity, but still... I think they should reconsider the people they pay to do their PR, legal, and other business) Besides that, how 'clean' are RHCP themselves? I mean, Dani Californication sounded all to blatantly like Tom Petty's "Mary Jane's Last Dance" and Lynrd Skynrd's "Sweet Home Alabama", and long before the Red Hot Chili Peppers ever existed, there was already a band by the name of "Chili Willy and The Red Hot Peppers". Pot? Kettle? Whiney rich brats? I don't know. But bad PR? of that I am convinced.
