Smashing Pumpkins Fight Virgin Records For "Artistic Integrity"

Billy Corgan wants more cha-ching. Seems Zeitgeist didn’t bring in the usual big dough for the band. Now Smashing Pumpkins are suing Virgin Records, their home during the release of Siamese Dream, Mellon Collie and the Infinite Sadness, Adore, and Machina/The Machines of God saying the label used the band’s name in promotional deals that hurt the band's credibility with fans.More specifically, the Smashing Pumpkins are pissed that Virgin licensed their likeliness to a "Pepsi Stuff" promotion with Amazon.com and Pepsi Co. This directly threatens the band's reputation for "artistic integrity."Yesterday, March 24th, in a breach-of-contract lawsuit filed in Los Angeles Superior Court the Smashing Pumpkins noted that the the label can sell digital downloads of the Pumpkins’ songs in their current deal, but Virgin does not have the right to use the band in promotional campaigns to sell outside products.The band said it’d "never grant such authority to Virgin, or any other entity” as it has "worked hard for over two decades to accumulate a considerable amount of goodwill in the eyes of the public.”The Pumpkins are demanding Virgin pay them the profits earned in the promotion and asks that the label never use the band’s name or music in the future.

  1. indieguy311 says Ug. Will they win? Wouldn't they basically have to prove that their losses on the last album are due to the loss of goodwill which can directly be attributable to Virgin?

  3. democlez says I'm no lawyer, but I think they could make a case by avoiding the whole 'lost cred' argument and focusing more on the point that the label used Smashing Pumpkin's likeness in a promotion without their permission. I can see them getting at least a portion of the promotion's profits this way. Like indieguy pointed out, it would be pretty difficult to prove a direct correlation between the unauthorized promotion to their losses on the last album. Personally I think their losses can be attributed to the 7 years between albums. A large portion of their loyal fans' tastes have probably changed drastically since the last release. The remaining die-hard fans probably felt alienated by the first single's sugar-sweet pop sound.

    Sorry, maybe I've missed something, but I haven't seen anything that suggests that their decision to sue Virgin has anything to do with sales of Zeitgeist.

    Virgin used their music without their permission, and they're suing because that use potentially damages their reputation as a band who don't generally allow their music to be used in advertising. I don't think Zeitgeist and its takings, or lack thereof (I don't know how it did - I'd imagine it did alright by most bands' standards), come into it. Unless you've heard otherwise?
